Abstract

This research to describe Poltabes Padang discretion form and base discretion to the arragement traffic accident case which cause victim die. This research is about socio legal research which is done in Poltabes Padang. The sample in this research are investigator police, presecutor, and judge who ever handle traffic accident case which case victim die. Collecting data including primary data and secundary data. Data analysis to determine discretion form and basic discretion is done whit qualitative descriptive method. The result of research show that discretion form which is done is birocracy discretion which deviate and hanging over corruptive. Eventhough basic discretion including yuridic discretion are UU No. 2 year 2002 about Policement chapter 18 (1), (2), and chapter 19 (1) and also explanation chapter 5 verse 1 letter j UU No. 8 year 1981 about “Hukum Acara Pidana” and non yuridic discretion are peaceful, a letter to not insist and material discretion from investigator side.
