Abstract

Law is a rule, that arrange national and state life. The imposition of law is arranged in constitution in which all citizens equal before the law and government and shall uphold the law and the government without any exception. In fact, there have found practice that avoided from necessity of the law. Deviation that committed by individuals, or by a group of people who have an interest in the law in favor of personal or group interest to the exclusion of justice and public welfare are called Mafia Hukum. After the screening of the recording mafia practices in the process of evidence in judicial proceedings of the constitutional court in 2009 and that has to prove that legal mafia activities are indeed really exists and occurs in Indonesia. Announcement in many media, make people pay attention to the existence, that government had to make Satuan Tugas Pemberantasan Mafia Hukum based on Presidential Decree (Decree) No. 37 Year 2009 on the establishment of the Satuan Tugas Pemberantasan Mafia Hukum. Satuan Tugas Pemberantasan Mafia Hukum duty of coordination, evaluation, correction and monitoring that legal mafia eradication can be done effectively. Satuan Tugas Pemberantasan Mafia Hukum is also authorized to conduct cooperation with various state agencies and conduct an evaluation, research and other matters as may be necessary to obtain required information of all agencies of government. However, if analyzed from its formation of the Satuan Tugas Pemberantasan Mafia Hukum is a part of the president's powers as an executive, it's just that this institution has the authority within a very wide domain of judicial. The emergence of the vast authority of a president decisions in the field of judicial against the Satuan Tugas Pemberantasan Mafia Hukum is interesting to more examine about the position in the Indonesian state administration system. From the results of studies it appears that the Satuan Tugas Pemberantasan Mafia Hukum that was formed by a presidential decree directly responsible to the President under the Unit Kerja Presiden Bidang Perencanaan dan Pengawasan Pembangunan (UKP-PPP) so it can be concluded that the Satuan Tugas Pemberantasan Mafia Hukum is one part of the executive authority of the President.
