Abstract

This article about accountabiliti at hospitals for medical malpractice in relation whit the medical seruice is a sociologist research about the legal principle, norm and various legal definition concerning contractual law, torl and judiciat decision retated to accountability by the hospitat for medicat matpractice. The resutt of research at Dr- Sardiito Hospital and a public hospitat in the Sleman subdistrict of yogyakarta shows that relation between hospital and doctor in the medical service executionn is legal relationship based on giving medical seruice. tn the execution of the medical seruices bydoctor in the hospital, the doktor bears full responsibility for the rights and duties. The complete freedom in exercising his rights and responsibitities of the doctor deteminated by the type of medical seruice which has to be giving to the patient.
