Abstract

The production sharing contract is needed because owners of land want to get the benefit from their land but they can not cultivate it for many reasons, causing they invite other people to cultivate their land based on the agreernent of production sharing which is made orally. This way of creating a contract may cause uncertainly of land use and disadvantages for cultivating farmers. To prevent the problems, the Indonesian government issued the law No. 2 af 1960, aiming at creating production sharing contracts that based on the principle of justice between land owners and cultivatingfarmers and lhe contract should be made in written. However, this orticle shows that local people did not want to implement the law, because of the complexity of the procedure to have the contract and the village head did not lvtow about the law.
