Abstract

The production sharing contract is needed because owners of land want to get the benefit from their land but they can not cultivate it for many reasons, causing they invite other people to cultivate their land based on the agreement af production sharing whiclt is mode orally. This way of creating a contract may cause uncertainty of tand use and disadvantages for cultivatingfarmers. To prevent the problems, the Indonesian government issued the law No. 2 of 196A, aiming at creating production sharing contracts that based on the principle ofiustice between land owners and cultivating farmers and the contract should be made in written. However, this article shows that local people did not want to implement the law, because of the complexity of the procedure to have the contract and the village head did not know about the law.
