Abstract

Function of protection, conservancy and restoration to cultural heritage objects at peacetime or wartime in international and national become of crucial important. This research try to look for answer to some problems, are: (1) how arrangement International Law of Humaniter about protection in state rights and obligations and continuation of cultural object in armed conflict and (2) how also arrangement Indonesia government of Law National in order to protection of cultural object and consistent its with International Law of Humaniter. Resulf of research indicate that in the reality there is coherent and strong law order of International Law of Humaniter about protection of cultural object, which is Convention of Den Haag 1954, Additional Protocol of Convention of Jenewa 1949, The Convention World Cultural Natural Heritage 1972, even also there are its arrangement in Statute of Roma 1998. While lndonesia beside judicially and moral tied with all conventions above. lndanesia have also Protectian of Cultural heritage and Preserve with Keppres No 26 1989, beside have also owned Law of no. 5 1992 about Cultural heritage. Only now which not yet in this time likely is unity of action and attitude either from international society, so also from government of Indonesia in doing conservancy and protection to existing cultural objects.
