Abstract

Government RUle or law does not pay attention to the law that used in traditional society that also can say primitive like traditional society of Mentawai. However, through the low that used in Mentawai, disolving a conflict can Be done by agreement between two side who have conflict. By this way, justice factor is the main point ta make a decision. But the govermnet rule or positive law often has opinion that disolving problem by using custom does not resolve the problem and still illegal because every conflict must be disolved by government through the element of standing law and making a decision that finishes a person who fault and a phisical he sent to the jail. Disolving conflict by this way can make both satisfied and if disolving problem as done by using government law. Mentawai society feels that the problem does not disolve completely and it does not make the society who has conflict satisfy. But in reality, the government understands about the culture and local values that can improve and make the government law completely.
