Abstract

Background of this research is because the duty of the company to implemented the corporate social responsibility (CSR). It has arranged in regulation, which is in regulation No. 25 in 2007 about financial investment (UUPM) and regulation No. 40 in 2007 about incorporated company (UUPT) as a follow up from concern 33 UUD 1945. Therefore, CSR is not the responsibility of morality but it is responsibility of law. The difference of formulation and CSR meaningfully in UUPT and UUPM will surface the law conflict. This conflict has an impact to consequences as a shape of CSR implementation. With the result, the implementation is depend on the commitment, perception, perspective, and necessity of the company it self. Based on this background, writer fined some problems. They are: how to CSR execution financial investment company in West Sumatra, how to apply the sanctions, and obstruction in CSR execution. The research method that use is Juridical Sociology. This research approach stressing in maintenance practice and law applies in CSR execution by the company. After the writer was doing this research and discussing, therefore, the writer have some conclusion, they are : BUMN company executed the CSR based on the certainty of BUMN ministerial regulation, No. Per-05/MBU/2007, it isn’t based on the certainty concern 74 UUPDT. The company that it is not include in BUMN, there are some regulation yet. The orientation of CSR execution just the philanthropy (filantropis). Commitment, big and small a company and established is very influenced the CSR execution. There is no company that gets sanction yet in CSR execution. Obstruction in CSR execution is no regulation yet from government that arranges the Corporate Social Responsibility (CSR).
