Abstract

The rapid development of science and technology produce significant progress in telecommunication and transportation. The distance is not a big matter anymore because it opens the door befween countries. This condition eased people to enter and exit from one country to another. The entering offoreigners to a country has positive and negative impacts. The country could except if the impact is positive. On the other hand, if the impact is negative, it will bring many problems to the country and of course those countries would take strict action in forms of deportation. The problem of the research are:first, how the implementation of deportation of Brazilians according to International law in human rights perspectiver second, how the procedure of deportation of Brazilians done by Immigration officer Padang. In this legal research the writer uses the method of empirical sociology that is research which applies the method using problems approach by relating the effective norms with the facts in the field. Meanwhile, the technique of data processing is by grouping the collected data and editing them. Then the writer makes qualitative analysis by elaborating them in words not in statistics way. From the result of the research, the writer can obtain some points that are the deportation process of Brazilians has appropriately applied by Indonesian government based on universally human rights instruments. Deportation procedure is different between one counuy to another country according to their own immigration law. Finally, the procedure of deportation of Brazilians in Immigration Offtcer Padang has already properly implemented based on the law of Indonesian Immigration.
