Abstract

The ObJectives of this study are to investigates the changes of communal landtenure system, land conflict, and its resolution plocess. The research was conductedt nagari Simawang. Subdistrict Rambatan, District tanah datar, Province West Sumatera. This research ls a case study in its nature. A qualitative approach was used. The data are collected by observation-participation technique and depth interview. The data werw analyed by on quolitative-interpretative technique, and the report of this research has ethnography-descriptive character. There are many problems can be find in this research : firstly,the changes of landtenure system at Minangkabau, especially in pawner system (Pegang Gadai), and the changes of communal landtenure to individually lanowner. Secondly, the raising af land conflict influenced by many factors, such as, uncle affectatian on nece or nephew, lawsuit between family, the changes of uncle role, grant (hibah) system informality, pawner (Pegang gadoi) informality,informality of kekaburan batas tanah, and monetization system. Thirdly, the foctors that influences the changes of land solution process .fro* the adat law institution (Lembaga Hulatm Adat) to the country law institution (lembaga hulam negara).
